This is a very good question! Indeed it should have to be answered, because I don't understand it myself. I mean, WHY go on with this retrial of the sentencing phase if another Judge can remove the DP from this case in another month? WHY put the Alexanders and the jurors through this if another Judge can remove the DP? Why shell out all of the money that is going out for something that could be removed in another month?
IMO, if another Judge is even going to consider removing the DP from ja's case, then the retrial of the sentencing phase should come to a complete stop until that Judge rules on this.
IMO, ja should have NEVER been allowed to get her case into this Omnibus Hearing. ja was already found guilty and her crime does warrant the DP.
